DNS Notary LLC Terms of Service

DNS Notary LLC provides remote and mobile notary services subject to the following Terms of Service. These terms are designed for a Texas-based online notary business and should be reviewed by qualified legal counsel before publication.

Company and Acceptance

DNS Notary LLC is a Texas limited liability company providing traditional, mobile, and remote online notarization (RON) services where permitted by law.

By accessing the DNS Notary LLC website, booking an appointment, or using any notary service, the customer agrees to these Terms of Service and any referenced policies (such as Privacy Policy and Cancellation Policy).

If a customer does not agree to these terms, the customer must not use DNS Notary LLC’s website or services.

Notarial Services and Limitations

Notarial acts are performed exclusively by a commissioned Texas notary public, and for remote online notarizations, by a Texas online notary public authorized under Texas Government Code Chapter 406 and applicable administrative rules.

The notary public’s role is limited to verifying identity, witnessing signatures, and completing notarial certificates. DNS Notary LLC and its notaries do not provide legal, tax, or financial advice and do not draft documents for customers. Notaries will not perform electronic notarizations for wills, codicils, testamentary trusts, or other documents excluded from electronic transactions under Texas law.

DNS Notary LLC may decline or terminate a notarization if identity cannot be reasonably verified, if the signer appears unwilling, unaware, or coerced, if the document is incomplete, or if the requested act would violate law or professional standards.

Eligibility and Identity Verification

Customers must be at least 18 years old and legally competent to enter into binding agreements to use notarization services, except where a minor is permitted to sign with appropriate parental or legal guardian involvement under applicable law.

For RON sessions, the notary must be physically located in Texas, while signers may be located inside or outside Texas where their jurisdiction permits acceptance of remote notarizations.

Identity may be verified using personal knowledge, credible witnesses, or government-issued identification and, for RON, may also require credential analysis and knowledge-based authentication through the approved technology platform.

Remote Online Notarization Platform and Technology

DNS Notary LLC uses third-party RON technology providers for audio-video communication, electronic signatures, identity proofing, and electronic records.

Customers agree to the separate terms of use and privacy policies of these third-party providers and acknowledge that DNS Notary LLC does not control their systems, uptime, or security controls.

Customers are responsible for ensuring adequate internet connectivity, compatible devices, audio/video capability, and a suitable environment free from excessive noise or distractions for the RON session.

Scheduling, Fees, and Payments

Services are provided by appointment, which may include same-day or urgent requests subject to availability. Scheduled times are approximate and may be adjusted for traffic, technical issues, or prior engagements.

Fees for traditional, mobile, and remote notarization are based on Texas statutory notarial fees plus allowed additional charges as disclosed at the time of booking, including statutory maximums: up to $10 per notarial signature, $25 additional for remote online notarization, and travel or after-hours fees as permitted by Texas Government Code §406.024.

DNS Notary LLC may require payment in advance or at the time of service and may accept payment methods such as credit/debit card, electronic payment, or invoicing. Failure to pay or payment chargeback may result in cancellation of services or collection efforts.

Cancellations, No-Shows, and Rescheduling

Customers may cancel or reschedule appointments within the cancellation window specified in the published Cancellation Policy (for example, free cancellation within 24 hours of booking) without additional charge.

DNS Notary LLC reserves the right to charge a cancellation or no-show fee for appointments missed, significantly delayed, or cancelled outside the stated window, particularly where travel or preparation has already occurred.

If DNS Notary LLC must cancel or reschedule due to illness, technical failure, or other circumstances, reasonable efforts will be made to reschedule promptly or provide a refund of any prepaid fees for services not rendered.

Documents, Records, and Retention

Customers are responsible for ensuring that documents are accurate, complete, and in final form before notarization. Notaries generally will not review documents for content or legal sufficiency beyond what is required for the notarial certificate.

Texas notaries maintain a detailed record book (journal) for each act, including the date, signer name and address, method of identity verification, document description, and fees charged.

For RON, audio-video recordings, electronic journals, and related electronic records must be retained for at least 5 years from the notarization date (Texas Government Code §406.108). Traditional notary records are retained for 10 years as required by law.

DNS Notary LLC may store documents and related records using secure electronic storage solutions and may delete documents after the defined retention period except where law or regulation requires longer retention.

Customer Responsibilities and Prohibited Uses

Customers must provide accurate information, respond truthfully to questions, and promptly notify DNS Notary LLC of any changes to contact information or relevant circumstances affecting a scheduled notarization.

Customers must not request notarization of fraudulent, incomplete, or misleading documents, or use the services to facilitate unlawful, deceptive, or unethical conduct.

DNS Notary LLC may terminate access to services, decline future appointments, or report certain activity to appropriate authorities if fraud, coercion, or other unlawful behavior is suspected.

No Legal Advice and No Attorney-Client Relationship

DNS Notary LLC and its notaries do not act as attorneys and do not provide legal opinions, contract interpretation, or advice regarding whether a particular document is appropriate for a particular purpose.

Use of DNS Notary LLC’s services does not create any attorney-client relationship, fiduciary duty, or representation beyond the performance of requested notarial acts.

Customers are encouraged to consult their own legal counsel, tax advisor, or other qualified professional for advice concerning documents and transactions before requesting notarization.

Intellectual Property and Website Use

All content on the DNS Notary LLC website, including text, graphics, logos, and layout, is owned by DNS Notary LLC or its licensors and is protected by applicable intellectual property laws.

Customers and visitors may use the website solely for personal or internal business purposes related to evaluating or obtaining notary services, and may not copy, modify, or distribute website content without prior written permission.

Unauthorized use of the website, including attempts to circumvent security measures or interfere with service operation, may result in access termination and potential legal action.

Data Privacy and Security

DNS Notary LLC collects and processes personal information necessary to schedule appointments, verify identity, perform notarizations, and maintain legally required records, as described in its Privacy Policy.

Reasonable technical and organizational measures are used to protect personal data and electronic records, but absolute security cannot be guaranteed. Customers accept inherent security risks associated with internet-based services.

DNS Notary LLC may share limited information with third-party service providers (such as RON platforms, payment processors, and secure storage providers) as needed to deliver services and comply with legal obligations.

Disclaimers and Limitation of Liability

Services are provided on an “as available” basis, and DNS Notary LLC does not warrant uninterrupted availability of its website, scheduling tools, or third-party technology platforms.

To the fullest extent permitted by law, DNS Notary LLC’s total liability for any claim arising out of or related to a notarial act or service is limited to the amount paid by the customer for the specific service at issue, excluding any consequential, incidental, or indirect damages.

Nothing in these terms limits liability where such limitation is prohibited by applicable law, including certain consumer protection or professional responsibility obligations.

Indemnification

Customers agree to indemnify and hold harmless DNS Notary LLC, its members, employees, and notaries from claims, losses, or damages arising out of the customer’s misuse of services, provision of false information, or violation of these Terms of Service or applicable law.

This indemnification obligation includes reasonable attorneys’ fees and costs incurred in defending against such claims.

Governing Law, Venue, and Dispute Resolution

These Terms of Service are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute arising from or related to the services or these terms will be brought in the state or federal courts located in Bexar County, Texas, and the parties consent to the personal jurisdiction of those courts, except where applicable law requires a different venue.

DNS Notary LLC may, at its option, include provisions for mediation, arbitration, or other alternative dispute resolution mechanisms in a separate agreement or amendment to these terms.

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver

The failure of DNS Notary LLC to enforce any right or provision of these Terms of Service does not constitute a waiver of such right or provision, nor does waiver of any breach constitute waiver of any subsequent breach.

Entire Agreement

These Terms of Service, together with the Privacy Policy, Cancellation Policy, and any other policies or agreements referenced herein, constitute the entire agreement between the customer and DNS Notary LLC concerning the use of notary services and supersede all prior and contemporaneous agreements, understandings, and negotiations, whether written or oral.

Changes to Terms

DNS Notary LLC may update or modify these Terms of Service from time to time. Changes will be effective upon posting on the website unless a later effective date is stated.

Continued use of the website or services after any change constitutes acceptance of the revised terms. Customers should review the Terms of Service periodically for updates.
